Important Notice to Hirers
The Customer's attention is particularly drawn to the provisions of clause 19 (Limitation of liability) and responsibilities regarding equipment care, fuel usage (red diesel regulations), and insurance coverage.
1. Interpretation & Definitions
In these conditions, key terms such as “Consumer”, “Contract”, “Hire Goods”, “Rental”, and “Total Loss” define the operational parameters between Metro Fixings Ltd (Supplier) and the hiring entity (Customer).
2. Basis of Contract
These conditions apply to the Contract to the exclusion of any other terms that the Customer seeks to impose. Orders are deemed accepted only when the Supplier issues written confirmation.
3. Hire Period, Risk & Care of Goods (Part 1)
- Risk & Insurance: Risk passes upon leaving Supplier control. The Customer must maintain comprehensive insurance covering full replacement value and public liability.
- Red Diesel Restrictions: Strict compliance with HMRC red diesel regulations is mandatory. Use of red diesel without approved exemption incurs flushing and fuel refill charges.
- Maintenance & Security: Customers are responsible for proper daily care, security, and safe operation by qualified personnel. Unauthorized repairs are prohibited.
4. Damage Waiver, Loss & Termination
Where elected, the optional Damage Waiver covers accidental equipment damage and theft (subject to police notification within 48 hours and excess fee deductibles). In cases of total loss, replacement costs and liquidated damages apply.
